31. Kundmachung der Bundesministerin für EU und Verfassung betreffend Berichtigungen des Protokolls über die strategische Umweltprüfung zum Übereinkommen über die Umweltverträglichkeitsprüfung im grenzüberschreitenden Rahmen

Nach Mitteilung des Generalsekretärs der Vereinten Nationen vom 21. April 2017 musste die englische, französische und russische Sprachfassung des Protokolls über die strategische Umweltprüfung zum Übereinkommen über die Umweltverträglichkeitsprüfung im grenzüberschreitenden Rahmen, BGBl. III Nr. 50/2010, berichtigt werden.Nach Mitteilung des Generalsekretärs der Vereinten Nationen vom 21. April 2017 musste die englische, französische und russische Sprachfassung des Protokolls über die strategische Umweltprüfung zum Übereinkommen über die Umweltverträglichkeitsprüfung im grenzüberschreitenden Rahmen, Bundesgesetzblatt Teil 3, Nr. 50 aus 2010,, berichtigt werden.

Im englischen Text lauten die Änderungsanweisungen wie folgt:

1. Artikel 3 Abs. 41. Artikel 3 Absatz 4

Anstatt:

„The provisions of this Protocol shall not affect the right of a Party to maintain or introduce additional measures in relation to issues covered by this Protocol.”

muss es heißen:

„The provisions of this Protocol shall not affect the right of a Party to maintain or adopt additional measures in relation to issues covered by this Protocol.”

2. Artikel 4 Abs. 42. Artikel 4 Absatz 4

Anstatt:

„For plans and programmes referred to in paragraph 2 which determine the use of small areas at local level and for minor modifications […]”

muss es heißen:

„For plans and programmes referred to in paragraph 2 which determine the use of small areas at the local level and for minor modifications […]”

3. Artikel 10 Abs. 2 lit. a)3. Artikel 10 Absatz 2, Litera a,)

Anstatt:

1. „(a)Absatz a,
   The draft plan or programme and the environmental report including information on its possible transboundary environmental, including health, effects; and”

muss es heißen:

1. „(a)Absatz a,
   The draft plan or programme and the environmental report including information on its likely transboundary environmental, including health, effects; and”

4. Artikel 14 Abs. 14. Artikel 14 Absatz eins

Anstatt:

„The Meeting of the Parties to the Convention shall serve as the Meeting of the Parties to this Protocol. The first meeting of the Parties to the Convention serving as the Meeting of the Parties to this Protocol shall be convened not later than one year after the date of entry into force of this Protocol, and in conjunction with a meeting of the Parties to the Convention, if a meeting of the latter is scheduled within that period. Subsequent meetings of the Parties to the Convention serving as the Meeting of the Parties to this Protocol shall be held in conjunction with meetings of the Parties to the Convention, unless otherwise decided by the Meeting of the Parties to the Convention serving as the Meeting of the Parties to this Protocol.”

muss es heißen:

Anstatt:

muss es heißen:

1. „(a)Absatz a,
   The date of commencement of the procedure;”

An der deutschsprachigen Übersetzung sind folgende Korrekturen vorzunehmen:

1. Artikel 10 Abs. 1 und 21. Artikel 10 Absatz eins und 2

1. „(1)Absatz eins,Ist eine Ursprungspartei der Auffassung, dass die Durchführung eines Plans oder eines Programms voraussichtlich erhebliche grenzüberschreitende Auswirkungen auf die Umwelt, einschließlich der Gesundheit, haben wird, oder stellt eine Vertragspartei, die voraussichtlich erheblich betroffen sein wird, ein entsprechendes Ersuchen, so benachrichtigt die Ursprungspartei die betroffene Vertragspartei so früh wie möglich vor der Annahme des Plans oder des Programms.
2. (2)Absatz 2,Die Benachrichtigung enthält insbesondere

   1. a)Litera a
      den Entwurf des Plans oder des Programms und den Umweltbericht mit den Informationen über voraussichtliche grenzüberschreitende Auswirkungen auf die Umwelt, einschließlich der Gesundheit, und
   2. b)Litera b
      Informationen über das […]“

2. Anhang V Pkt. 3 lit. a)2. Anhang römisch fünf Pkt. 3 Litera a,)

„3.Ziffer 3 Das vorgesehene Verfahren, einschließlich folgender Angaben:

1. a)Litera a
   das Datum des Beginns des Verfahrens; […]“

Auf Grund des § 5 Abs. 2 des Bundesgesetzblattgesetzes – BGBlG, BGBl. I Nr. 100/2003 idgF, wird die Berichtigung der französischen und russischen Sprachfassung durch Auflage im Bundesministerium für europäische und internationale Angelegenheiten kundgemacht.Auf Grund des Paragraph 5, Absatz 2, des Bundesgesetzblattgesetzes – BGBlG, Bundesgesetzblatt Teil eins, Nr. 100 aus 2003, idgF, wird die Berichtigung der französischen und russischen Sprachfassung durch Auflage im Bundesministerium für europäische und internationale Angelegenheiten kundgemacht.
