164. Kundmachung: | Änderungen der Artikel 55, 59, 61, 62 und 63 der Internationalen Gesundheitsvorschriften (2005) vom 23. Mai 2005 |
Auf Grund des Paragraph 5, Absatz eins, Ziffer 5, des Bundesgesetzblattgesetzes – BGBlG, Bundesgesetzblatt Teil eins, Nr. 100 aus 2003,, zuletzt geändert durch das Bundesgesetz Bundesgesetzblatt Teil eins, Nr. 88 aus 2024,, wird kundgemacht:
Anlässlich der in Genf abgehaltenen 75. Weltgesundheitsversammlung der WHO wurden durch Beschluss WHA75.12 vom 28. Mai 2022 die Änderungen der Artikel 55, 59, 61, 62 und 63 der Internationalen Gesundheitsvorschriften (2005) vom 23. Mai 2005 Bundesgesetzblatt Teil 3, Nr. 98 aus 2008,, zuletzt geändert durch Bundesgesetzblatt Teil 3, Nr. 182 aus 2016,) angenommen.
Die geänderten Artikel lauten demnach wie folgt:
Ziffer eins Amendments to these Regulations may be proposed by any State Party or by the Director-General. Such proposals for amendments shall be submitted to the Health Assembly for its consideration.
Ziffer 2 The text of any proposed amendment shall be communicated to all States Parties by the Director-General at least four months before the Health Assembly at which it is proposed for consideration.
Ziffer 3 Amendments to these Regulations adopted by the Health Assembly pursuant to this Article shall come into force for all States Parties on the same terms, and subject to the same rights and obligations, as provided for in Article 22 of the Constitution of WHO and Articles 59 to 64 of these Regulations, subject to the periods provided for in those Articles with respect to amendments to these Regulations.
Ziffer eins The period provided in execution of Article 22 of the Constitution of WHO for rejection of, or reservation to, these Regulations shall be 18 months from the date of the notification by the Director-General of the adoption of these Regulations by the Health Assembly. Any rejection or reservation received by the Director-General after the expiry of that period shall have no effect.
1bis The period provided in execution of Article 22 of the Constitution of WHO for rejection of, or reservation to, an amendment to these Regulations shall be 10 months from the date of the notification by the Director-General of the adoption of an amendment to these Regulations by the Health Assembly. Any rejection or reservation received by the Director-General after the expiry of that period shall have no effect.
Ziffer 2 These Regulations shall enter into force 24 months after the date of notification referred to in paragraph 1 of this Article, and amendments to these Regulations shall enter into force 12 months after the date of notification referred to in paragraph 1bis of this Article, except for:
Ziffer 3 If a State is not able to adjust its domestic legislative and administrative arrangements fully with these Regulations or an amendment thereto within the period set out in paragraph 2 of this Article, as applicable, that State shall submit within the applicable period specified in paragraph 1 or 1bis of this Article a declaration to the Director-General regarding the outstanding adjustments and achieve them no later than 12 months after the entry into force of these Regulations or an amendment thereto for that State Party.
römisch eins f a State notifies the Director-General of its rejection of these Regulations or of an amendment thereto within the applicable period provided in paragraph 1 or 1bis of Article 59, these Regulations or the amendment concerned shall not enter into force with respect to that State. Any international sanitary agreement or regulations listed in Article 58 to which such State is already a party shall remain in force as far as such State is concerned.
Ziffer eins States may make reservations to these Regulations or an amendment thereto in accordance with this Article. Such reservations shall not be incompatible with the object and purpose of these Regulations.
Ziffer 2 Reservations to these Regulations or an amendment thereto shall be notified to the Director-General in accordance with paragraphs 1 and 1bis of Article 59 and Article 60, paragraph 1 of Article 63 or paragraph 1 of Article 64, as the case may be. A State not a Member of WHO shall notify the Director-General of any reservation with its notification of acceptance of these Regulations. States formulating reservations should provide the Director-General with reasons for the reservations.
Ziffer 3 A rejection in part of these Regulations or an amendment thereto shall be considered as a reservation.
Ziffer 4 The Director-General shall, in accordance with paragraph 2 of Article 65, issue notification of each reservation received pursuant to paragraph 2 of this Article. The Director-General shall:
States Parties objecting to a reservation to an amendment to these Regulations should provide the Director-General with reasons for the objection.
Ziffer 5 After this period, the Director-General shall notify all States Parties of the objections he or she has received with regard to reservations. In the case of a reservation made to these Regulations, unless by the end of six months from the date of the notification referred to in paragraph 4 of this Article a reservation has been objected to by one third of the States referred to in paragraph 4 of this Article, it shall be deemed to be accepted and these Regulations shall enter into force for the reserving State, subject to the reservation. In the case of a reservation made to an amendment to these Regulations, unless by the end of three months from the date of the notification referred to in paragraph 4 of this Article, a reservation has been objected to by one third of the States referred to in paragraph 4 of this Article, it shall be deemed to be accepted and the amendment shall enter into force for the reserving State, subject to the reservation.
Ziffer 6 If at least one third of the States referred to in paragraph 4 of this Article object to the reservation to these Regulations by the end of six months from the date of the notification referred to in paragraph 4 of this Article or, in the case of a reservation to an amendment to these Regulations, by the end of three months from the date of the notification referred to in paragraph 4 of this Article, the Director-General shall notify the reserving State with a view to its considering withdrawing the reservation within three months from the date of the notification by the Director-General.
Ziffer 7 The reserving State shall continue to fulfil any obligations corresponding to the subject matter of the reservation, which the State has accepted under any of the international sanitary agreements or regulations listed in Article 58.
Ziffer 8 If the reserving State does not withdraw the reservation within three months from the date of the notification by the Director-General referred to in paragraph 6 of this Article, the Director-General shall seek the view of the Review Committee if the reserving State so requests. The Review Committee shall advise the Director-General as soon as possible and in accordance with Article 50 on the practical impact of the reservation on the operation of these Regulations.
Ziffer 9 Director-General shall submit the reservation, and the views of the Review Committee if applicable, to the Health Assembly for its consideration. römisch eins f the Health Assembly, by a majority vote, objects to the reservation on the ground that it is incompatible with the object and purpose of these Regulations, the reservation shall not be accepted and these Regulations or an amendment thereto shall enter into force for the reserving State only after it withdraws its reservation pursuant to Article 63. römisch eins f the Health Assembly accepts the reservation, these Regulations or an amendment thereto shall enter into force for the reserving State, subject to its reservation.
Ziffer eins A rejection made under Article 61 may at any time be withdrawn by a State by notifying the Director-General. In such cases, these Regulations or an amendment thereto, as applicable, shall enter into force with regard to that State upon receipt by the Director-General of the notification, except where the State makes a reservation when withdrawing its rejection, in which case these Regulations or an amendment thereto, as applicable, shall enter into force as provided in Article 62. In no case shall these Regulations enter into force in respect to that State earlier than 24 months after the date of notification referred to in paragraph 1 of Article 59 and in no case shall an amendment to these Regulations enter into force in respect to that State earlier than 12 months after the date of notification referred to in paragraph 1bis of Article 59.
Ziffer 2 The whole or part of any reservation may at any time be withdrawn by the State Party concerned by notifying the Director-General. In such cases, the withdrawal will be effective from the date of receipt by the Director-General of the notification.“
Ziffer eins Tout État Partie ou le Directeur général peut proposer des amendements au présent Règlement. Ces amendements sont soumis à l’Assemblée de la Santé pour examen.
Ziffer 2 Le texte de tout amendement proposé est communiqué à tous les États Parties par le Directeur général au moins quatre mois avant l’Assemblée de la Santé à laquelle cet amendement est soumis pour examen.
Ziffer 3 Les amendements au présent Règlement adoptés par l’Assemblée de la Santé conformément au présent article entrent en vigueur à l’égard de tous les États Parties dans les mêmes conditions et sous réserve des mêmes droits et obligations que ceux prévus à l’article 22 de la Constitution de l’OMS et aux articles 59 à 64 du présent Règlement, sous réserve des délais prévus par ces articles en ce qui concerne les amendements au présent Règlement.
Ziffer eins Le délai prévu à l’article 22 de la Constitution de l’OMS pour refuser le présent Règlement ou y formuler des réserves est de 18 mois à compter de la date de notification, par le Directeur général, de l’adoption du présent Règlement par l’Assemblée de la Santé. Un refus ou une réserve reçus par le Directeur général après l’expiration de ce délai seront sans effet.
1 bis Le délai prévu à l’article 22 de la Constitution de l’OMS pour refuser un amendement au présent Règlement ou y formuler des réserves est de 10 mois à compter de la date de notification, par le Directeur général, de l’adoption dudit amendement au présent Règlement par l’Assemblée de la Santé. Un refus ou une réserve reçus par le Directeur général après l’expiration de ce délai seront sans effet.
Ziffer 2 Le présent Règlement entre en vigueur 24 mois après la date de notification visée au paragraphe 1 du présent article, et les amendements au présent Règlement entrent en vigueur 12 mois après la date de notification visée au paragraphe 1 bis du présent article, excepté à l’égard :
Ziffer 3 Si un État est dans l’incapacité d’ajuster ses dispositions législatives et administratives nationales dans le délai prévu au paragraphe 2 du présent article pour les mettre en pleine conformité avec le présent Règlement ou avec un amendement à celui-ci, selon le cas, il adresse au Directeur général dans le délai applicable spécifié au paragraphe 1 ou 1 bis du présent article une déclaration concernant les ajustements qui restent à apporter et procède auxdits ajustements au plus tard dans les 12 mois suivant l’entrée en vigueur du présent Règlement ou d’un amendement à celui-ci à l’égard de cet État Partie.
Si un État notifie au Directeur général son refus du présent Règlement ou d’un amendement à celui-ci dans le délai applicable prévu au paragraphe 1 ou 1 bis de l’article 59, le présent Règlement ou l’amendement concerné n’entre pas en vigueur à l’égard de cet État. Tout accord ou règlement sanitaire international visé à l’article 58 auquel cet État est déjà Partie demeure en vigueur pour ce qui le concerne.
Ziffer eins Tout État peut formuler des réserves au Règlement ou à un amendement à celui-ci en application du présent article. Ces réserves ne doivent pas être incompatibles avec l’objet et le but du présent Règlement.
Ziffer 2 Toute réserve au présent Règlement ou à un amendement à celui-ci doit être notifiée au Directeur général conformément aux dispositions des paragraphes 1 et 1 bis de l’article 59 et de l’article 60, du paragraphe 1 de l’article 63 ou du paragraphe 1 de l’article 64 selon le cas. Un État non Membre de l’OMS doit aviser le Directeur général de toute réserve qu’il fait dans sa notification d’acceptation du présent Règlement. Tout État qui formule des réserves doit en faire connaître les motifs au Directeur général.
Ziffer 3 Un refus partiel du présent Règlement ou d’un amendement à celui-ci équivaut à une réserve.
Ziffer 4 En application des dispositions du paragraphe 2 de l’article 65, le Directeur général notifie toute réserve reçue au titre du paragraphe 2 du présent article. Le Directeur général :
Les États Parties qui formulent une objection à une réserve à un amendement au présent Règlement doivent en indiquer les motifs au Directeur général.
Ziffer 5 Passé ce délai, le Directeur général avise l’ensemble des États Parties des objections reçues concernant les réserves. En cas de réserve portant sur le présent Règlement, si, à l’issue du délai de six mois à compter de la date de la notification visée au paragraphe 4 du présent article, un tiers des États visés au paragraphe 4 du présent article ne se sont pas opposés à la réserve, celle-ci est considérée comme acceptée et le présent Règlement entre en vigueur à l’égard de l’État réservataire, à l’exception des dispositions faisant l’objet de la réserve. En cas de réserve portant sur un amendement au présent Règlement, si, à l’issue du délai de trois mois à compter de la date de la notification visée au paragraphe 4 du présent article, un tiers des États visés au paragraphe 4 du présent article ne se sont pas opposés à la réserve, celle-ci est considérée comme acceptée et l’amendement entre en vigueur à l’égard de l’État réservataire, à l’exception des dispositions faisant l’objet de la réserve.
Ziffer 6 Si un tiers au moins des États visés au paragraphe 4 du présent article s’opposent à une réserve au présent Règlement avant l’expiration du délai de six mois à compter de la date de la notification visée au paragraphe 4 du présent article ou, dans le cas d’une réserve à un amendement au présent Règlement, avant l’expiration du délai de trois mois à compter de la date de la notification visée au paragraphe 4 du présent article, le Directeur général en avise l’État réservataire pour que celui-ci envisage de retirer sa réserve dans un délai de trois mois à compter de la date de la notification que lui a adressée le Directeur général.
Ziffer 7 L’État réservataire continue de s’acquitter de toutes obligations portant sur l’objet de la réserve qu’il a acceptées dans le cadre d’un accord ou règlement sanitaire international visé à l’article 58.
Ziffer 8 Si l’État auteur d’une réserve ne retire pas celle-ci dans un délai de trois mois à compter de la date de la notification par le Directeur général visée au paragraphe 6 du présent article, et si l’État auteur de la réserve en fait la demande, le Directeur général demande l’avis du Comité d’examen. Le Comité d’examen informe le Directeur général, dans les meilleurs délais et conformément aux dispositions de l’article 50, des répercussions pratiques de la réserve sur l’application du présent Règlement.
Ziffer 9 Le Directeur général soumet la réserve et l’avis du Comité d’examen, le cas échéant, à l’Assemblée de la Santé pour examen. Si l’Assemblée de la Santé, par un vote à la majorité simple, s’oppose à la réserve au motif qu’elle est incompatible avec l’objet et le but du présent Règlement, la réserve n’est pas acceptée et le présent Règlement ou un amendement à celui-ci n’entre en vigueur à l’égard de l’État réservataire qu’après qu’il a retiré sa réserve conformément à l’article 63. Si l’Assemblée de la Santé accepte la réserve, le présent Règlement ou un amendement à celui-ci entre en vigueur à l’égard de l’État réservataire avec cette réserve.
Ziffer eins Un refus émis au titre de l’article 61 peut, à tout moment, être retiré par un État moyennant une notification adressée au Directeur général. Dans ce cas, le Règlement ou un amendement à celui-ci, selon le cas, entre en vigueur à l’égard de cet État à la date de la réception, par le Directeur général, de la notification, sauf si l’État émet une réserve lorsqu’il retire son refus, auquel cas le Règlement ou un amendement à celui-ci, selon le cas, entre en vigueur comme prévu à l’article 62. En aucun cas le Règlement n’entre en vigueur à l’égard de cet État avant un délai de 24 mois après la date de la notification visée au paragraphe 1 de l’article 59 et en aucun cas un amendement au présent Règlement n’entre en vigueur à l’égard de cet État avant un délai de 12 mois après la date de la notification visée au paragraphe 1 bis de l’article 59.
Ziffer 2 Tout ou partie d’une réserve peuvent à tout moment être retirés par l’État Partie concerné moyennant une notification adressée au Directeur général. Dans ce cas, le retrait prend effet à compter de la date de la réception, par le Directeur général, de la notification.“
Notifiziert ein Staat dem Generaldirektor seine Ablehnung dieser Vorschriften oder einer Änderung derselben innerhalb der in Artikel 59 Absatz 1 oder 1bis jeweils vorgesehenen Frist, so treten diese Vorschriften oder die betreffende Änderung in Bezug auf diesen Staat nicht in Kraft. Alle in Artikel 58 aufgeführten internationalen Sanitätsabkommen oder Gesundheitsvorschriften, deren Vertragspartei ein solcher Staat bereits ist, bleiben für diesen Staat in Kraft.
Vertragsstaaten, die gegen einen Vorbehalt zu einer Änderung dieser Vorschriften Einspruch erheben, sollen diesen Einspruch dem Generaldirektor gegenüber begründen.
Die vorstehenden Änderungen sind gemäß Artikel 59, der Internationalen Gesundheitsvorschriften mit 31. Mai 2024 in Kraft getreten.
Gemäß Artikel 61, der Internationalen Gesundheitsvorschriften haben die folgenden Vertragsstaaten dem Generalsekretär der WHO mitgeteilt, dass sie die vorliegenden Änderungen ablehnen: Iran, Neuseeland, Niederlande und Slowakei.
