Amendment of Article 15(4) of the Agreement Establishing the

African Development Fund concerning Procurement

THE BOARD OF GOVERNORS,

HAVING REGARD TO the Agreement Establishing the African Development Fund (the „Fund Agreement“), in particular Articles 2 (Purpose); 4 (Resources); 15(4)(a) (Conditions of Financing); 23 (Board of Governors: Powers); 25 (Board of Governors: Procedure); 29 (Voting) and 51 (Amendments);

RECOGNIZING that donor coordination and harmonization of procedures is essential in the context of the Paris Declaration on Aid Effectiveness;

AWARE of the need to harmonize the procurement rules of the Fund with those of other development partners with a view to increasing competitiveness and development effectiveness of the Fund;

HAVING CONSIDERED Document ADF/BG/WP/2008/11, in particular the recommendations contained therein for the amendment of Article 15(4)(a) of the Fund Agreement;

HEREBY DECIDES to amend the Fund Agreement by deleting Article 15(4)(a) of the Fund Agreement, and that the amended Article 15(4) shall read as follows:

1. 4. Ziffer 4
   Procurement shall be on the basis of international competition among eligible suppliers except in cases where the Board of Directors determines that such international competition would not be justified.

FURTHER DECIDES that the amendment to the Fund Agreement provided for in this Resolution shall enter into force on the date set forth in Article 51(1) of the Fund Agreement, following the adoption of this Resolution and the acceptance of the amendment therein by the participants (including State participants) in accordance with Article 51 of the Fund Agreement.

Fonds africain de développement relatif à la passation des marchés

LE CONSEIL DES GOUVERNEURS,

VU l’Accord portant création du Fonds africain de développement, (l’“Accord du Fonds“), en particulier les articles 2 (Objectifs), 4 (Ressources), 15 (4) (a) (Conditions de financement), 23 (Conseil des gouverneurs : Pouvoirs), 25 (Conseil des gouverneurs : Procédure), 29 (Vote) et 51 (Amendements) ;

RECONNAISSANT que la coordination entre donateurs et l’harmonisation des procédures sont des facteurs essentiels dans le contexte de la Déclaration de Paris sur l’efficacité de l’aide ;

CONSCIENT de la nécessité d’harmoniser les règles de passation des marchés du Fonds avec celles des autres partenaires au développement afin d’accroître la compétitivité du Fonds et son efficacité en matière de développement ;

AYANT EXAMINE le Document ADF/BG/WP/2008/11, en particulier les recommandations qui y sont contenues pour l’amendement de l’article 15 (4) (a) de l’Accord du Fonds ;

DECIDE PAR LA PRESENTE RESOLUTION d’amender l’Accord du Fonds en supprimant l’article 15 (4) (a) de l’Accord du Fonds et que l’article 15(4) ainsi amendé se lira comme suit :

   L’acquisition de ces biens et services se fait par un appel à la concurrence internationale entre les fournisseurs répondant aux conditions fixées, sauf dans le cas où le Conseil d’administration estime que l’appel à la concurrence internationale n’est pas justifié.

DECIDE EN OUTRE que l’amendement à l’Accord du Fonds prévu dans la présente résolution entrera en vigueur à la date spécifiée à l’article 51 (1) de l’Accord du Fonds, après l’adoption de la présente résolution et l’acceptation de l’amendement y contenu par les participants (y compris les Etats participants) conformément à l’article 51 de l’Accord du Fonds.

Änderung von Artikel 15(4) des Übereinkommens über die Errichtung des Afrikanischen Entwicklungsfonds betreffend Beschaffung

DER GOUVERNEURSRAT

UNTER BEZUG AUF das Übereinkommen über die Errichtung des Afrikanischen Entwicklungsfonds1 (das „Fondsübereinkommen“), insbesondere die Artikel 2 (Zweck); 4 (Vermögenswerte); 15(4)(a) (Finanzierungsbedingungen); 23 (Befugnisse des Gouverneursrats); 25 (Verfahren des Gouverneursrats); 29 (Abstimmung) und 51 (Änderungen);

IN ANERKENNUNG , dass Geberkoordination und Harmonisierung von Abläufen im Zusammenhang mit der Pariser Deklaration über die Wirksamkeit von Entwicklungszusammenarbeit wesentlich sind;

IM BEWUSSTSEIN des Bedarfs nach Harmonisierung der Beschaffungsregeln des Fonds mit jenen anderer Entwicklungspartner um die Wettbewerbsfähigkeit und Entwicklungswirksamkeit des Fonds zu erhöhen;

NACH BERÜCKSICHTIGUNG des Dokuments ADF/BG/WP/2008/11, vor allem der darin enthaltenen Empfehlungen zur Änderung von Artikel 15(4)(a) des Fondsübereinkommens;

BESCHLIESST HIEMIT das Fondsübereinkommen durch Streichung dessen Artikel 15(4)(a) zu ändern und dass der geänderte Artikel 15(4) wie folgt lautet:

   Beschaffung erfolgt auf Basis internationalen Wettbewerbs unter berechtigten Anbietern abgesehen von Fällen in denen das Direktorium entscheidet, dass derartiger internationaler Wettbewerb nicht gerechtfertigt wäre.

BESCHLIESST WEITERS , dass die in dieser Resolution vorgesehene Änderung des Fondsübereinkommens, nach Annahme dieser Resolution und Annahme der darin enthaltenen Änderung durch die Teilnehmer (einschließlich der Teilnehmerstaaten) gemäß Artikel 51 des Fondsübereinkommens, an dem in Artikel 51(1) des Fondsübereinkommens festgelegten Datum in Kraft tritt.
